Advocacy Update

New laws will go into effect in the new year. On January 1, 2017, 192 new laws will officially go into effect in Illinois. A handful cover employment and labor law.

We will be monitoring the budget situation and other issues beginning on January 9th. The 100th General Assembly Inauguration will be on January 11, followed by the Governor's State of the State on January 25, and the Governor's Budget Address on February 15.

As part of an upcoming project to refresh the Chamber web site, a full page will be dedicated to advocacy/legislative issues to track and info for contacting local elected officials.

While the Department of Labor's (DOL) overtime rule may have been set aside (temporarily), there was another DOL ruling that came down earlier in 2016 that is moving ahead as planned in the new year. The Fiduciary Rule, which will impact not only an individual's IRA account, but also a businesses' 401 (k) plan.

The new rule redefines who is considered a "fiduciary" and makes a greater distinction between education and advice. It addresses "brokers" associated with both 401 (k) plans and IRA's and how they are compensated. The old "suitability" standards will now be replaced by ones of a "fiduciary" standard.

Business owners need to meet with the financial advisors associated with their company's retirement plan to inquire as to what capacity they are acting in and how they will be compensated moving forward.
